General Terms and Conditions (AGB)

for the online shop of Lemax-PA

1. Scope of application & contractual partners

1.1 These General Terms and Conditions (GTC) apply to all orders placed via our online shop lemax-pa.sellstart.at by consumers and entrepreneurs.

1.2 The contractual partner is Lemax-PA Sp.z.o.o UID: ATU 81954547 Fichtengasse 4 3441 Baumgarten Austria, hereinafter referred to as "we" or "Lemax-PA".

1.3 Deviating or supplementary general terms and conditions of the customer shall not apply unless we expressly agree to them in writing.

2. Offers & conclusion of contract

2.1 Our product presentations in the online shop do not constitute a legally binding offer, but a non-binding invitation to order.

2.2 A purchase contract is concluded when you send an order via our online shop and we accept this by sending an order confirmation by e-mail or by delivering the goods.

2.3 All prices are in EUR including statutory VAT, but excluding shipping costs, unless otherwise stated.

3. Dispatch & delivery

3.1 Dispatch is at the risk and expense of the buyer, unless otherwise agreed.

3.2 Delivery times are indicated on the respective product page. You will be informed by us in the event of delays in delivery.

3.3 Partial deliveries are permitted, provided they are reasonable.

3.4 Delivery is made to the specified delivery address. Access for lorries is necessary for safe delivery. Unloading by us means parking next to the vehicle. The customer shall provide suitable parking space.

4. Payment

4.1 The following payment methods are available in our online shop:

- Apple Play

- Google Pay

- Online credit card payment (e.g. VISA Mastercard)

- Fast online bank transfer

4.2 Payments are due immediately upon conclusion of the contract.

4.3 In the event of late payment, we reserve the right to charge reminder fees and default interest at the statutory rate.

5. Right of cancellation (for consumers)

Consumers have the right to cancel the contract within 14 days without giving reasons. You can find the exact details in our cancellation policy.

There is no right of cancellation for goods that have been specially manufactured or tailored to customer requirements (e.g. custom-made products for horticultural projects).

6. Retention of title

The goods remain our property until full payment has been received.

7. Warranty & Liability

7.1 The statutory warranty rights apply.

7.2 Obvious defects must be reported immediately upon receipt of the goods.

7.3 Complaints about defective goods that have already been installed or processed are excluded.

7.4 The following applies to entrepreneurs: The warranty period is 6 months. § Section 933b ABGB does not apply.

8. Data protection

Your data will only be used to fulfil the contract and will not be passed on to third parties - details can be found in our privacy policy.

9. Place of jurisdiction & choice of law

9.1 Austrian law applies. UN sales law is excluded.

9.2 The place of jurisdiction is, as far as legally permissible, the registered office of Lemax-PA SP.z.o.o

10. Final provisions

Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
